Letter of Urgency to President of the United States of America

Your Excellency President of the United States of America
It has come to our knowledge that you have scheduled a visit to our country in this May. As Vietnamese citizens, we are pleased and honoured to welcome the Head of State of one of the most powerful nation in the world.
At present, we believe you are receiving a considerable number of petitions urging improvement in various aspects of the situation of human rights in Vietnam. Standing with other voices, we – as members of the Interfaith Council of Vietnam, a civil society organization comprised of religious dignitaries from 5 largest religions in Vietnam with a mission to defend religious freedom, human rights and democracy for the country – would like to submit this urgent letter of ours, in order to offer you an overview of on-the-ground situation of religions in Vietnam, a reality in which the Vietnamese government continuously stamps on religious freedom of its citizens.
1- First, the Vietnamese government is drafting the Law on belief and religion (which would replace 2004’s Ordinance on Belief and Religion). Even though during drafting process, a variety of religious associations or communities had been asked for their feedback and opinions, the majority of which recommended either revising or re-drafting the whole document, in the end the government introduced a version completely subject to their own will. From our perspective, the current draft law poses a grave peril as the real motivations behind a law that would govern every form of religious practice and activity but that is being legislated by an authoritarian and atheist ruler, can only be explained as follows: (i) to turn religions into convenient and obedient servants of the regime, (ii) to debilitate religions’ functions, and (iii) to desensitize religious conscience at the sight of atrocious misconduct perpetuated by the government. The current draft law on belief and religion, if passed, would provide a solid legal basis for the Vietnamese authorities to continue their unrelenting crackdown on independent religions, only more covertly.
2- In reality, the Vietnamese government has never ceased their oppression of many religious associations, from state-sanctioned ones to those that are being outlawed (including 4 out of 5 Religions in the Interfaith Council of Vietnam). Following are recent examples:
- In April 2015, a Holy Temple of the independent Cao Dai Church in Tuy An, Phu Yen province was bulldozed by forces from local government. Later, the state-controlled Cao Dai Church was given permission to take over two other Holy Temples of the independent Cao Dai Church in Cam Pha, Quang Ninh province and in Ha Long city. On 28thSeptember 2015, Mr. Hua Phi, Chief for Administration of the independent Cao Dai Church, was banned from travelling abroad and had his passport confiscated at Tan Son Nhat airport after he was invited to a conference on religious freedom in Thailand.
- With regard to the Catholic Church, the Vietnamese authorities are attempting to seize the whole area of Thien An monastery in Thua Thien-Hue. As recent as 6th April 2016, the authorities of Quang Binh province sent polices to Huong Phuong parish in Vinh diocese, which then caused a commotion leading to the injuries of many Catholics. Earlier this year, priest Anthony Dang Huu Nam of Phu Yen parish in Vinh diocese had been stopped midway on the road and severely beaten.
- The Hoa Hao Buddhist Purist Church has been subjected to oppression for decades, with more than 20 dignitaries of the Church having been or currently being imprisoned. On the 69th death anniversary of the Church founder - Master Huynh Phu So on 2nd April 2016, local authorities employed all tactics from intimidation and arrest to physical abuse in order to obstruct observance of the ceremony. On 16th April 2016, Mr. Le Van Soc – Deputy Leader of the Church – was stopped on the road by police and physically attacked when he was coming home from a local worshipping event.
- As for the Vietnam Unified Buddhist Church, Dat Quang monastery and Phuoc Buu pagoda are target of perpetual harassment by the authorities of Ba Ria – Vung Tau province. Venerable Thich Thien Phuc (of An Cu pagoda in Da Nang city) is routinely faced with travel restriction, whereas Lien Tri pagoda in Thu Thiem, district 2, Sai Gon (Ho Chi Minh city) – presided by Venerable Thich Khong Tanh – is being forced to move to another place at the prospect of being bulldozed towards the end of 2016 and is constantly under surveillance.
- The Evangelical Lutheran Church of America and Vietnam has always been regarded as an outlawed community by the Vietnamese government. Pastor Nguyen Cong Chinh is serving an 11-year sentence in prison. On 14thApril 2016, his wife was summoned to local police station and severely beaten because she had previously met with the U.S Ambassador-at-Large for International Religious Freedom. Meanwhile, the Vietnam Mennonite Church – presided by pastor Nguyen Hong Quang – was routinely subjected to oppression by means of vandalizing or physical assault of the Church’s members.
Your Excellency,
We are aware that as a part of your visit to Vietnam, you are going to have multiple discussions with the Vietnamese government over issues related to national security, bilateral trade as well as human rights and democracy. Therefore, we sincerely hope that you will regard talks over human rights and democracy as a priority, because only when human rights and democracy are implemented can we guarantee stability in national security and sustainability in economic growth. Besides, it has been proved that it is thanks to America’s national spirit of respect for human rights and democracy as enshrined in your Constitution that to this day the United States of America still remains to be the most powerful country across the globe in various aspects from politics and economics to technology, international affairs and national defence.
We hope that for the remaining period of your presidency, you would leave a legacy treasured beyond boundaries, just as your predecessors such as George Washington, Thomas Jefferson, Abraham Lincoln and Theodore Roosevelt did. We are looking forward to your visit to Vietnam in hopes that it would tremendously benefit not only American people but Vietnamese citizens as well.

Kính thưa Ngài Tổng thống,
Tin tức cho biết Ngài sắp thăm viếng đất nước chúng tôi vào tháng 5 tới. Nhân dân Việt Nam hân hoan chào đón vị lãnh đạo chính trị cao nhất của quốc gia hùng mạnh nhất thế giới là Hoa Kỳ.
Lúc này đây, đã và đang có nhiều thỉnh nguyện thư gởi đến Ngài, trình bày tình hình nhân quyền tại đất nước chúng tôi dưới nhiều phương diện. Chúng tôi là các thành viên trong Hội đồng Liên tôn Việt Nam, một tổ chức xã hội dân sự quy tụ nhiều chức sắc thuộc 5 tôn giáo lớn tại Việt Nam nhằm đấu tranh cho tự do tôn giáo và dân chủ nhân quyền, cũng xin được gởi đến Ngài thư khẩn này, để trình bày với Ngài về việc nhà cầm quyền Việt Nam chà đạp quyền tự do tôn giáo.
1- Trước hết, nhà cầm quyền Việt Nam sắp ban hành Luật tín ngưỡng tôn giáo (thay thế cho Pháp lệnh tín ngưỡng tôn giáo năm 2004). Dù có xin ý kiến nhiều tổ chức và cộng đồng tôn giáo về các dự thảo của Luật này và phần lớn yêu cầu phải viết lại hoàn toàn hay hủy bỏ nó, nhà cầm quyền rốt cục đã chỉ biên soạn Luật tôn giáo theo ý của họ. Đối với chúng tôi, đây là một nguy cơ rất lớn, vì một luật quy định các sinh hoạt tôn giáo lại do những kẻ cầm quyền vừa độc tài toàn trị, vừa vô thần duy vật soạn ra, thì chỉ có ba mục tiêu: một là biến các cộng đồng tôn giáo thành công cụ phục vụ chế độ, hai là thành những định chế đã đánh mất bản chất, ba là thành những tập thể câm lặng trước sai lầm và tội ác của nhà cầm quyền. Luật tín ngưỡng tôn giáo mới này sẽ là cơ sở pháp lý để nhà cầm quyền tiếp tục bách hại các tôn giáo tại Việt Nam một cách dữ dội và tinh vi hơn.
2- Trên thực tế, trong thời gian gần đây, nhà cầm quyền Việt Nam tiếp tục bách hại các Giáo hội, từ những Giáo hội được họ cho phép hoạt động đến những Giáo hội bị họ tùy tiện đặt ra ngoài vòng pháp luật (trong đó có 4/5 Giáo hội chúng tôi). Chúng tôi xin đan cử vài thí dụ:
- Hội thánh Cao Đài, tháng 4-2015, đã bị nhà cầm quyền ủi sập Thánh thất Tuy An ở tỉnh Phú Yên. Tiếp đó, họ hỗ trợ cho Cao Đài quốc doanh cưỡng chiếm Thánh thất Cẩm Phả ở tỉnh Quảng Ninh, Thánh thất Phường Cao Sanh ở thành phố Hạ Long. Chánh trị sự Hứa Phi, một chức sắc lãnh đạo, đi tham dự Hội nghị tự do tôn giáo tại Thái Lan ngày 28-9- 2015, đã bị an ninh sân bay Tân Sơn Nhất tịch thu hộ chiếu đến nay chưa trả.
- Về Giáo hội Công giáo, nhà cầm quyền đang muốn cướp lấy toàn bộ đất đai của đan viện Thiên An ở Thừa Thiên-Huế. Mới đây, ngày 06-04-2016, giới chức tỉnh Quảng Bình đã đem công an đến đàn áp giáo xứ Hướng Phương thuộc Giáo phận Vinh, làm cho nhiều giáo dân bị thương. Đầu năm nay, công an đã chặn đường hành hung linh mục Antôn Đặng Hữu Nam, quản xứ Phú Yên, giáo hạt Thuận Nghĩa, giáo phận Vinh.
- Giáo hội Phật giáo Hòa Hảo Thuần túy đã bị bách hại trong nhiều thập niên qua, trên 20 chức sắc PGHH đã bị cầm tù. Gần đây, trong ngày kỷ niệm 69 năm Đức Huỳnh Giáo Chủ thọ nạn, (02-04-2016), nhà cầm quyền đã dùng mọi thủ đoạn hăm dọa, bắt bớ, đánh đập để Giáo hội này không thể tổ chức cuộc lễ. Hôm 16-4-2016, ông Lê Văn Sóc, Phó Hội trưởng Giáo hội đã bị công an chặn đường hành hung tàn bạo sau khi đi dự một lễ giỗ.
- Về Giáo hội Phật giáo Việt Nam Thống nhất, tịnh thất Đạt Quang và chùa Phước Bửu của Thượng tọa Thích Vĩnh Phước ở Bà Rịa Vũng Tàu thường bị công an đàn áp, sách nhiễu. Thượng tọa Thích Thiên Phúc (chùa An Cư ở Đà Nẵng) đi đâu cũng gặp khó khăn, ngăn trở. Chùa Liên Trì ở Thủ Thiêm, quận 2 Sài Gòn của Hòa thượng Thích Không Tánh bị công an thường trực canh gác, theo dõi ngày đêm và bị đe dọa cưỡng chế, giải tỏa sau tháng 5 hoặc cuối năm 2016.
- Giáo hội Tin Lành Liên hữu Lutheran Việt Nam-Hoa Kỳ thì từ trước đến giờ vẫn bị đặt ra ngoài vòng pháp luật. Mục sư Hội trưởng Nguyễn Công Chính đang bị án tù 11 năm. Bà vợ của ông, hôm 14-04, đã bị công an bắt về đồn đánh trọng thương vì trước đó đã gặp đại sứ lưu động của Hoa Kỳ về tự do tôn giáo. Giáo hội Tin Lành Mennonite của Mục sư Nguyễn Hồng Quang thì suốt năm 2015 đã nhiều lần bị bách hại, đánh người, phá cơ sở một cách tàn độc.
Thưa Ngài Tổng thống,
Ngài sắp đến làm việc với nhà cầm quyền Việt Nam về những vấn đề liên quan tới an ninh quốc phòng, kinh tế thương mại và dân chủ nhân quyền, như đường lối xưa rày của chính phủ Mỹ. Chúng tôi hy vọng rằng Ngài sẽ ưu tiên đặt vấn đề nhân quyền dân chủ, vì chỉ khi nhân quyền dân chủ được thực thi, thì mới thực sự bảo đảm được an ninh quốc phòng và mới thực sự phát triển được kinh tế thương mại. Ngoài ra, sở dĩ Hiệp chủng quốc Hoa Kỳ hiện là quốc gia hùng mạnh nhất hoàn cầu về mọi phương diện, từ chính trị đến kinh tế, từ khoa học đến kỹ thuật, từ ngoại giao đến quốc phòng… đó chính là nhờ tinh thần tôn trọng nhân quyền và cổ vũ dân chủ nằm trong chính Hiến pháp tuyệt vời của Quý quốc.
Chúng tôi cầu chúc Ngài, trong thời gian sắp mãn nhiệm kỳ Tổng thống, sẽ không những để lại trên quốc gia mà còn trên cả quốc tế nhiều dấu ấn tốt đẹp như các vĩ nhân tiền nhiệm của Ngài: George Washington, Thomas Jefferson, Abraham Lincoln, Theodore Roosevelt. Chúng tôi ước mong chuyến đi của Ngài sang Việt Nam sẽ đem lại nhiều thành quả không những cho nhân dân Hoa Kỳ mà còn cho cả nhân dân Việt Nam chúng tôi.
Chúng tôi xin chân thành cảm ơn Ngài và cầu mong mọi sự an lành đến cho Ngài cũng như cho toàn thể nước Mỹ.
